Mid South Dumpster Rentals, LLC. – Dumpster Rental Agreement​

 

1. Parties & Dates

Customer/client name and dates of this agreement determined at time of service. Customer/client to provide valid driver's license/company information upon signing the agreement. A valid form of payment must also be provided before service can begin. This Agreement is between Mid South Dumpster Rentals, LLC and any of it's customers.

 

2. Delivery, Placement & Pickup

• Customers must provide legal, stable placement and unobstructed access.
   

• Mid South will deliver and remove the dumpster within scheduled windows. If access is blocked on pickup day, a Missed Pickup Fee of $150 and/or additional rental day charges apply
   

 

3. Permitted & Prohibited Materials

Permitted Items: 

• Non-hazardous solid waste—household trash

• Lumber

• Porcelain, tile

• Plastics

• Carpet, insulation, construction debris

• Yard clippings, natural vegetation 

• Inert materials like wood, drywall, roofing shingles, stone, brick, or concrete (must adhere to heavy material rules)

Prohibited: Including, but not limited to​

• Hazardous or regulated wastes (paints, solvents, chemicals, oil, fuels, asbestos, batteries, barrels, chemicals, pesticides, etc.)

• Liquids of any kind or pressurized vessels

• Tires, electronics, refrigerant appliances, medical waste, TVs, computers

• Petroleum-contaminated soil, oil filters, fluorescent bulbs, railroad ties, radioactive materials
   

• Concrete, brick, stone, asphalt only up to ¼ full in ONLY OUR 10 YARD CONTAINERS and separated from other debris unless prior approval is granted

Violation consequences:

​

• Costs, fines, legal claims, cleanup, and handling fees will be passed to the Customer

 

4. Weight Limits & Overage Fees

*Weight and fees aligned with local industry standards

• Heavier-than-expected material (e.g., stone, brick) may trigger refusal unless pre-approved

• Containers are weighed at disposal facility; overweight charges will be invoiced.
   

 

5. Loading & Safety Requirements

• No debris above rim; container must be tarp-ready and end doors closed and secured

• Distribute load evenly to prevent tipping and ensure safe handling

• Customer is responsible for securing dumpster and for any damage to surface, lawn, piping, landscaping, utilities, or structures unless caused by Company negligence
   

 

6. Rental Period & Fees

• Base rental covers [1-7] days (per agreement)
   

• Extensions cost $[50] per extra day, subject to availability
   

• Missed Pickup Fee: $[150/day] if dumpster is inaccessible
   

• Wait Time: $[50/hour] for delays on site that exceed a 30 minute allotted drop time
   

 

7. Inspection & Refusal Rights
Mid South reserves the right to inspect loads upon delivery or pickup. If containers are over-filled, overweight, or contain prohibited materials, we may refuse service and charge associated fees. Customers may be responsible for unloading material if deemed refusable.

 

8. Permits & Approvals
Customer is responsible for obtaining any required municipal permits and paying associated fees for placement in public areas

 

9. Liability & Indemnity

• Customer indemnifies, defends, and holds harmless Mid South from any claims, liabilities, costs, or expenses (including attorney fees) arising from Customer’s negligence, misuse, prohibited materials, overweight, or overfilled containers .
   

• Company liability is expressly limited to the rental fee paid; no liability for indirect damages unless caused by gross negligence, with a maximum cap of rental amount
   

 

10. Payment Terms

• All fees (base rental, overage, extra days, fines) due upon pickup or invoicing.
   

• Past-due payments incur interest at 10% per month, plus collection expenses
   

 

11. Governing Law
This Agreement is governed by the laws of the State of Mississippi. Disputes shall be resolved exclusively in the courts of Hinds County, Mississippi.

 

12. Entire Agreement & Amendments

• This represents the entire agreement; any amendments must be in writing and signed by both parties.
   

• If any term is invalid under law, the remainder of the Agreement stays in effect.
